 Welcome to the Elba Municipal Court web page. The Internet provides our Court with an additional method to communicate with you and to provide information about the Court and the Magistrate’s Office and their operations.

It is important to remember that appearance and conduct are important when coming to Court. All persons present in the Courtroom shall be clean, neat and dressed in an appropriate manner, and conduct themselves in a respectful manner reflecting dignity and respect for the Court.

 

 

It is also very important to BE ON TIME for a Court appearance. Be sure to allow AMPLE time for traffic, parking, and security screening when you arrive. You must be present in the courtroom when the docket is called. A warrant will be issued if you fail to answer when your name is called. 

 

If you are a witness on a case, your presence is necessary for a trial to go forward. If a witness is not present in the Courtroom, a case is subject to dismissal or reschedule. Remember that all persons must pass through metal detectors and their purses and bags will be screened. All persons are also subject to search.

 Cellular Phones/Pagers:

  • All cellular phones and pagers must be turned off or placed on the vibrate mode while in the courtroom.

 Weapons:

  •  Weapons (guns and knives) are strictly prohibited in the Courtroom. This does not apply to law enforcement personnel. Also, items such as pocket knives, scissors or anything deemed as unacceptable will be confiscated upon entry to the building. Certain confiscated items will be held and may be returned upon departure.

REMEMBER

  • The defendant is presumed innocent until proven guilty.
  • The defendant does not have to testify or present witnesses.
  • The City has the burden of proof of guilt.
  • The City is always represented by a lawyer.
  • A defendant may represent himself at Trial, or be represented by an attorney licensed by the State of Alabama.

 Instructions to Defendant:

 

If you have been charged with a traffic offense in the Municipal Court of Elba, Alabama. You have a right to a trial. The date set for your trial is entered on the citation just above the space for your signature. You must be in court at the specified time and place if you do not have this case handled in some manner prior to that time. Failure to do so may result in arrest, additional expense and/or loss of your priviledge to drive.
  • If you have not been convicted of one speeding violation within the past 12 months, and are charged with a speeding violation listed below and wish to PLEAD GUILTY and pay the fine and court costs, you may do so.
  • If you have not been convicted of two or more traffic violations within the past twelve months and are charged with one of the offenses listed below and wish to PLEAD GUILTY and pay the fine and court costs, you may do so. To settle your case by mail, you must complete the plea of guilty form on the back of your citation and mail it to the Court along with payment in the amount indicated. Your payment in the form of a money order must be mailed in time so it will arrive at the Court before the appearance date shown on the citation. Please make money order payable to "City of Elba Municipal Court".
  • You can pay you ticket on line at elbatix.com. The amount below is the ticket amount. The company that handles on line payments adds a surcharge to this amount.
